Indicted Washington State Auditor Troy Kelley abruptly returned to office Tuesday, ending a seven month leave of absence pending his federal trial.

Washington State Auditor Troy Kelley has been dealt a setback by the Ninth Circuit Court of Appeals. A three-judge panel Tuesday declined to hear Kelley’s claim of double jeopardy.

Kelley faces a retrial next year on charges related to his past real estate services business. Kelley’s first trial earlier this year ended with the jury acquitting him of one count but deadlocking on the remaining 14 charges.

Kelley was charged with possession of stolen property, money laundering, making false statements and filing false tax returns. Prosecutors accused Kelley of pocketing more than $3 million in homeowner fees that should have been refunded.

Kelley’s legal team says it is reviewing its options. The Democrat did not run for re-election and will leave office in January.
