Judge Rejects Lawsuit Against LTD

A lawsuit against Lane Transit District and the Federal Transit Administration has been rejected, with prejudice, by a federal judge.

Our Money Our Transit had filed the suit claiming that the way the agencies did their environmental impact process for the West Eugene EmX was inadequate under the National Environmental Policy Act, or NEPA.

LTD Spokesman Andy Vobora says U-S District Court Judge Thomas Zilly had a lot of leeway in assessing the process.

"In fact, they found through summary judgment that there was no problem with how LTD and the Federal Transit Administration went through the process working with the community to develop the project and evaluate the environmental impacts."
 
The judge said there was no merit to the arguments Our Money Our Transit made in the case. The group has not yet decided whether to appeal the ruling to the 9th Circuit Court. OMOT has been fighting LTD's plan to expand its EmX rapid transit system to West Eugene for years.
